Terms of Service

1. Summary

The App is a tool to help you run and manage live poker tournaments (structures, blind levels, breaks, and related timing). It is free to use and is not a real-money gambling service, online casino, or gaming operator.

2. The App and what it is not

Tourney Ticker provides software and timing-related functionality for organizers and players. We do not operate games, stakes, or payouts. You are solely responsible for ensuring that your use of the App and any events you run comply with applicable laws where you are, including rules on gambling, charitable gaming, and minors.

We do not warrant that tournament structures, timers, or displayed information are accurate, complete, or suitable for any particular event. You use the App at your own risk as further described in Section 11.

3. Eligibility

You must be at least 13 years old, or the age of digital consent in your country if that age is higher than 13, to use the App. By using the App, you represent and warrant that you meet this requirement.

4. Price and distribution

The App is offered free of charge and has no in-app purchases, subscriptions, or advertising within the App as described in our Privacy Notice.

The App is distributed through Google Play. When you obtain the App from Google Play, your use of Google’s services is also subject to Google’s applicable terms and policies.

5. License grant and restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your personal, non-commercial purposes, in accordance with these Terms.

You may not:

• Use the App for commercial purposes (for example, as part of a paid product or service you offer to third parties, or to operate the App as a service bureau), except where applicable law gives you rights we cannot contractually exclude;
• Rent, lease, sell, sublicense, or otherwise redistribute the App or your rights under these Terms;
• Copy, modify, adapt, translate, or create derivative works of the App, except as permitted by applicable law;
• Reverse engineer, decompile, or disassemble the App, except to the extent mandatory law expressly allows;
• Remove or alter any proprietary notices or labels on the App;
• Use the App in any way that violates law or these Terms.

6. Acceptable use

You agree not to:

1. Use the App in a manner that could interfere with, disrupt, or negatively affect the App, our systems, or other users;
2. Use the App for any illegal or unauthorized purpose;
3. Attempt to gain unauthorized access to our systems, accounts, or data;
4. Violate any applicable local, national, or international law or regulation.

We may suspend or terminate access where we reasonably believe this section or these Terms have been breached, as described in Section 9.

7. Privacy

Your use of the App is governed by our Privacy Notice, which is incorporated by reference into these Terms. By using the App, you acknowledge that you have reviewed the Privacy Notice (or had the opportunity to do so).

8. Your content and data

Processing of personal and tournament-related data is described in the Privacy Notice. We do not add extra contractual guarantees beyond what is stated there and what applicable law requires.

You may request deletion of your data as described in the Privacy Notice. We do not warrant uninterrupted, error-free, or permanent availability of any data on our systems; storage and sync are provided as described in the Privacy Notice and subject to Section 11.

9. Service availability, changes, and termination

We may modify, suspend, or discontinue any part of the App or related services at any time, with or without notice, for maintenance, security, legal, or operational reasons.

We may suspend or terminate your access if we reasonably believe you have violated these Terms or pose a risk to the service or others.

You may stop using the App at any time by uninstalling it. Provisions of these Terms that by their nature should survive (including Sections 10–13 and applicable limitations) will survive termination.

10. Intellectual property

Unless otherwise stated, the App, its software, branding, and materials we provide are owned by Volodymyr Kosynets or our licensors and are protected by copyright, trademark, and other intellectual property laws. Except for the limited license in Section 5, no rights are granted to you.

11. Disclaimer of warranties

Some jurisdictions do not allow certain disclaimers; in those jurisdictions, our warranties are limited to the maximum extent permitted by law.

12. Limitation of liability

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Volodymyr Kosynets from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any law or third-party rights.

14. Changes to these Terms

We may modify these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this document and post the updated Terms on https://poker.vkosinets.com (or a successor page we designate).

Continued use of the App after the updated Terms are posted constitutes your acceptance of the changes, where permitted by law. If you do not agree, you must stop using the App and uninstall it.

15. Governing law

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to conflict-of-law principles that would apply another jurisdiction’s laws.

Subject to mandatory provisions of applicable law, you agree that the courts of Ukraine shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the App, except where the law requires otherwise.
